Terms of Service

Snap Rent Appraisal Australia ("Snap Rent Appraisal", "we", "us" or "our") is operated by Daniel West, ABN 99 570 025 706, of 76 Chaprowe Rd, The Gap QLD 4061.

1. About these Terms

These Terms govern use of snaprentappraisal.com, the Snap Rent Appraisal property manager portal, property owner Snap Rent Appraisal experiences, Snap Rent Appraisal QR codes and links, mail-out and related services, and any other Snap Rent Appraisal services that refer to these Terms, together, the Service. Our Privacy Policy forms part of these Terms.

2. Acceptance

You agree to these Terms when you create an Property Manager Account, purchase or start a paid or trial subscription, submit a Snap Rent Appraisal property request, use a feature that expressly asks you to accept these Terms, or otherwise use the Service after being given reasonable notice that these Terms apply. If you use Snap Rent Appraisal on behalf of a company, agency or other organisation, you represent that you are authorised to bind that organisation. If you do not agree to these Terms, do not use the Service.

3. What Snap Rent Appraisal does

Snap Rent Appraisal is a technology and lead-management platform. It allows participating property managers to create branded links and QR codes that enable property owners and other authorised property users to provide property information, photograph parts of a property, provide contact information, and request contact from the relevant property manager regarding a property appraisal. The resulting submission is made available to the relevant property manager in accordance with the Service, their subscription plan and the property owner's permissions.

4. Snap Rent Appraisal is not a property manager or valuer

Snap Rent Appraisal does not act as a property manager for a property owner, appoint a property manager on a property owner's behalf, enter into an agency agreement for the sale of property, provide a formal property valuation, represent itself as a registered valuer, determine the market value of a property, guarantee any appraisal amount, provide financial, investment, legal, taxation or lending advice, or guarantee that a property owner will appoint a property manager or sell a property. Any property appraisal, opinion, market estimate, comparable-sales analysis, marketing recommendation or other real-estate advice is provided by the relevant property manager or agency. A Snap Rent Appraisal submission is not a substitute for an independent valuation prepared by an appropriately qualified or registered valuer where a formal valuation is required.

5. No agency relationship with participating property managers

Participating property managers and agencies are independent businesses. They are not employees, partners, representatives, franchisees or property managers of Snap Rent Appraisal merely because they use the Service. Snap Rent Appraisal provides technology to participating property managers but does not control their professional judgement or individual dealings with property owners. Nothing in these Terms creates an agency agreement between a property owner and a participating property manager.

6. Property manager eligibility and responsibilities

An Property Manager Account may only be used for legitimate business purposes. Each property manager represents and warrants that:

Property managers are responsible for determining which professional and regulatory requirements apply to them.

7. Property manager profile content and advertising claims

Property managers may upload or provide photographs, logos, agency branding, professional statistics, properties managed or appraised, average days to lease, testimonials, taglines, biographies, custom statements, and other advertising or promotional material. The property manager is responsible for that material. By submitting it, the property manager represents and warrants that it is accurate and not misleading, any factual or performance claim can be substantiated, required qualifications or disclaimers have been included, it does not infringe another person's intellectual-property rights, necessary permissions have been obtained, and its publication complies with applicable real-estate, advertising and consumer laws. Snap Rent Appraisal may remove or refuse material that we reasonably believe breaches these requirements. Our ability to review content does not transfer responsibility for the content from the property manager to Snap Rent Appraisal.

8. Property owner eligibility and authority

A person submitting a property through Snap Rent Appraisal must be at least 18 years old, have authority or permission to photograph and provide information about the property, provide information they reasonably believe to be accurate, respect the privacy of other occupants, and avoid uploading unlawful material or information they are not entitled to disclose. A person does not need to be the registered owner in every circumstance, but they must have legitimate authority or permission to make the submission. Snap Rent Appraisal does not independently verify property ownership, identity, authority to sell or authority to appoint a property manager merely because a submission has been made.

9. Property photographs and submissions

The person uploading photographs retains ownership of any rights they hold in those photographs. They grant Snap Rent Appraisal a non-exclusive, royalty-free licence to host, store, copy, process, resize, display and transmit the photographs and other submitted information to the extent reasonably necessary to operate the Service, provide the submission to the selected property manager, provide support, maintain security, comply with law, and exercise rights under these Terms. The licence continues for as long as reasonably necessary to provide the Service and deal with lawful retention, backup and dispute requirements. Users should avoid including people, identity documents, financial information, medical information, security credentials or other unnecessary personal information in property photographs.

10. Property owner information and property manager contact

A property owner's information may be provided to the property manager identified in the Snap Rent Appraisal experience through which the property owner makes the submission. A property manager may use that information to respond to the rental appraisal request and for another purpose only where the property owner has consented, the use is reasonably expected and lawful, or the use is otherwise permitted or required by law. A property manager must comply with all applicable privacy, Spam Act, telemarketing and Do Not Call requirements. An rental appraisal request must not be treated as unlimited consent to place a property owner into unrelated or indefinite marketing campaigns. Where separate marketing consent is required, the property manager is responsible for obtaining and recording that consent.

11. Partially completed submissions

The Service may identify a property submission as soon as a user begins the Snap Rent Appraisal process. Depending on the Service design, information already entered may be retained and may become visible to the selected property manager as a partially completed or "Warm" lead, provided the required privacy notice and permissions have been given. Property managers must treat partially completed information with the same care and confidentiality as completed submissions.

12. Transferring a lead to another property manager

A lead, property submission, photograph or property owner contact record must not be sold, transferred or disclosed to another property manager merely because the receiving property manager wishes to acquire it. Where Snap Rent Appraisal provides a feature allowing a property opportunity to be sent to another property manager, the transferring property manager must have the property owner's consent or another lawful basis for that transfer. Snap Rent Appraisal may require confirmation of this authority before allowing a transfer. Property managers remain responsible for ensuring the transfer is lawful.

13. Subscriptions

Property manager subscriptions are billed at the price and frequency displayed when the property manager subscribes. The features included in each plan are those stated on the Pricing page or checkout screen at the time the relevant subscription period begins. Unless stated otherwise: subscriptions are billed monthly in advance; subscriptions automatically renew each month until cancelled; there is no minimum lock-in period; cancelling prevents the next renewal; access continues until the end of the prepaid billing period; and subscription features and lead entitlements reset in accordance with the plan shown at checkout. Prices will be identified as including or excluding GST as applicable.

14. Trials and promotional periods

Where a promotional code or offer provides a free initial period: valid payment details may still be required; no subscription fee will be charged during the stated free period; unless cancelled before the free period ends, the subscription will automatically convert to the paid plan disclosed when the trial commenced; and the applicable subscription fee will then be charged for the next billing period. We will not intentionally conceal the fact that a trial converts to a paid subscription. Eligibility restrictions may apply to promotional offers. Unless stated otherwise, a person or business is not entitled to repeatedly open accounts to obtain multiple new-customer trials.

15. Cancellation

A property manager may cancel a subscription using the cancellation functionality provided through the Service or by contacting us. Cancellation takes effect at the end of the current prepaid billing period unless otherwise stated. No additional recurring fee will be charged after cancellation takes effect.

16. Refunds

Except where required by the Australian Consumer Law or another applicable law, fees already paid for a billing period are generally not refundable merely because the property manager changes their mind, does not use the Service, receives fewer leads than expected, or cancels part-way through a billing period. We will investigate genuine billing errors. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.

17. Changes to subscription pricing

We may change subscription prices for future billing periods. Where a price increase affects an existing paid subscription, we will provide reasonable advance notice. The property manager may cancel before the increased price applies. A price increase will not retrospectively change amounts already paid.

18. Failed payments

If a payment fails, we may retry the payment, notify the account holder, temporarily restrict paid features, or suspend the subscription until payment is resolved. We will not charge undisclosed penalties merely because a payment failed.

19. Lead volume and quality

Snap Rent Appraisal provides tools designed to help property managers generate and manage rental appraisal opportunities. We do not guarantee any particular number of leads; that a person commencing a Snap Rent Appraisal is the legal owner of the property; that information supplied by a property owner is complete or accurate; that a lead is exclusive; that a property owner will respond to the property manager; that a property owner genuinely intends to sell; that a lead will become a listing; any conversion rate; any sales commission; or any particular financial result. Property managers remain responsible for conducting their normal qualification and due-diligence processes.

20. Mail-out services

Snap Rent Appraisal may allow property managers to order branded printed materials for distribution through a third-party print, mail or distribution provider. Where a property manager orders a mail-out: the property manager is responsible for approving the artwork and information appearing on the material; professional claims and advertising content remain the property manager's responsibility; quantities, delivery areas and coverage may be based on estimates supplied by fulfilment partners; individual addresses may be excluded because of delivery rules, access restrictions, advertising-material restrictions, invalid addresses or other operational reasons; stated production and delivery dates are estimates unless expressly guaranteed; and fulfilment may be affected by third-party providers, postal networks, weather, access and other circumstances outside Snap Rent Appraisal's reasonable control. Snap Rent Appraisal will use reasonable care in arranging paid fulfilment services and will address failures in accordance with applicable consumer law.

21. Referral program and account credits

Where Snap Rent Appraisal operates a property manager referral program: eligibility and credit amounts are those displayed when the referral is made; referrals must be genuine; self-referrals, duplicate accounts and fraudulent activity are prohibited; a credit may be conditional on the referred property manager becoming a qualifying paid subscriber; account credits are applied against eligible Snap Rent Appraisal charges and are not cash unless expressly stated otherwise; and credits created by error, fraud or abuse may be reversed. Material changes to earned credits will not be applied retrospectively without a legitimate reason.

22. Acceptable use

Users must not: access another person's account without authority; scrape or mass-extract lead information; circumvent subscription or lead-access limits; use automated means to overload or interfere with the Service; introduce malware or malicious code; attempt to discover another user's password or credentials; use Snap Rent Appraisal for unlawful surveillance or harassment; upload unlawful, defamatory or infringing material; impersonate another person; fabricate property owner leads; misuse referral programs; sell or trade property owner information contrary to these Terms; misrepresent Snap Rent Appraisal as a licensed real estate agency or valuation provider; or use the Service in a way that creates unreasonable security, legal or reputational risk.

23. Snap Rent Appraisal intellectual property

Snap Rent Appraisal and its licensors retain ownership of the Service, including software, source code, interfaces, platform design, templates, workflows, documentation, trademarks, branding, graphics, and other proprietary material, excluding content provided by property managers and property owners. No ownership of Snap Rent Appraisal intellectual property transfers to a user. Property managers receive a limited, non-exclusive, non-transferable right to use the Service during their authorised subscription.

24. Property manager branding licence

A property manager grants Snap Rent Appraisal a non-exclusive, royalty-free licence during the account relationship to use the property manager's name, headshot, logo, agency name, brand colours, profile information, and approved marketing content for the purpose of providing the Service, including producing branded pages, emails, QR experiences and mail-outs requested by the property manager. The property manager represents that they have authority to grant this licence.

25. Third-party services

Snap Rent Appraisal relies on third-party services including hosting, databases, image storage, payments, communications and fulfilment providers. Those services may experience outages or change their functionality. We remain responsible for obligations that the law does not permit us to exclude, but cannot guarantee that every third-party network or service will be continuously available. Links to third-party websites are provided for convenience and do not mean that Snap Rent Appraisal controls or endorses everything on those websites.

26. Availability and maintenance

We aim to provide a reliable Service but do not guarantee uninterrupted or error-free availability. We may undertake reasonable maintenance, security work, upgrades, bug fixes, infrastructure changes, and emergency remediation. Where practicable, we will attempt to minimise material disruption to paid users.

27. Changes to the Service

We may improve, replace or discontinue features from time to time. We will not knowingly make a material reduction to the core functionality of a prepaid plan without reasonable notice where doing so would materially disadvantage affected customers. Where a material change significantly reduces what an existing paid customer has purchased, we may provide an appropriate remedy including allowing cancellation.

28. Suspension

We may suspend access where reasonably necessary because of suspected account compromise, unlawful use, fraud, serious or repeated breach of these Terms, material risk to property owners or other users, non-payment, a security incident, or a legal or regulatory requirement. Where appropriate, we will give the user an opportunity to remedy the issue. Immediate suspension may occur where delay would create material security, legal or safety risk.

29. Termination

A property manager may terminate their subscription by cancelling it. We may terminate an account for a serious or repeated breach of these Terms after reasonable notice where appropriate. We may terminate the Service for business reasons on reasonable notice. If we terminate an active paid subscription for our convenience rather than because of the property manager's breach, we will provide an appropriate refund or credit for the unused prepaid portion of the subscription.

30. Data following account closure

Following account closure, access to the dashboard may cease. Users should export information they are lawfully entitled to retain before the account closes where export functionality is provided. Snap Rent Appraisal may subsequently delete or de-identify information in accordance with our Privacy Policy and retention procedures. Information already lawfully disclosed to an independent property manager or downloaded by that property manager may remain subject to that property manager's independent legal record-keeping obligations.

31. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or another applicable law. Where legislation permits our liability for a non-excludable guarantee relating to services supplied primarily for business purposes to be limited, our liability is limited, at our option, to supplying the relevant services again, or paying the reasonable cost of having the relevant services supplied again.

32. Limitation of liability

To the maximum extent permitted by law, Snap Rent Appraisal is not liable for indirect, incidental, special or consequential loss arising from use of the Service, including loss of opportunity, anticipated commissions, anticipated listings, profit, revenue, goodwill, or business reputation, except to the extent such liability cannot lawfully be excluded. Snap Rent Appraisal is not responsible for an appraisal, valuation, representation, advice or professional service independently provided by a property manager. For claims arising from an Property Manager Account, and to the extent permitted by law, Snap Rent Appraisal's aggregate liability arising from the Service will not exceed the greater of the subscription fees actually paid by that Property Manager Account during the 12 months immediately preceding the event giving rise to the claim, or AUD $500. This limitation does not apply to liability that cannot lawfully be limited and is not intended to protect Snap Rent Appraisal from liability for fraud or deliberate misconduct.

33. Property manager indemnity

To the extent permitted by law, a property manager or agency will indemnify Snap Rent Appraisal against third-party claims, losses and reasonable costs to the extent caused by that property manager's unlawful use of property owner information, unlawful marketing or telemarketing, breach of privacy obligations, unauthorised transfer or sale of a lead, misleading or unlawful advertising material, infringement of another person's intellectual-property rights, professional appraisal or real-estate advice, material breach of these Terms, or fraudulent or wilful misconduct. This indemnity does not apply to the extent the relevant loss was caused by Snap Rent Appraisal's own unlawful conduct, negligence or breach.

34. Privacy

Personal information is handled in accordance with the Snap Rent Appraisal Privacy Policy. Property managers acknowledge that information obtained through Snap Rent Appraisal can include highly private information about a person's home and must be handled accordingly.

35. Complaints and disputes

If a dispute relates to Snap Rent Appraisal, the user should first contact admin@snaprentappraisal.com. The parties should attempt in good faith to resolve the dispute informally. Nothing in this clause prevents either party from seeking urgent court relief or exercising rights available under applicable consumer legislation. Disputes concerning a property manager's appraisal, professional conduct or real-estate services should ordinarily be raised directly with the relevant property manager or agency and, where appropriate, the relevant state or territory regulator.

36. Governing law

These Terms are governed by the laws of Queensland, Australia. The parties submit to the courts of Queensland and courts entitled to hear appeals from them, subject to any mandatory rights a user has under applicable law.

37. Changes to these Terms

We may update these Terms as the Service or law changes. Minor or administrative changes may take effect when published. Where a material change significantly affects an existing paid customer's rights or obligations, we will provide reasonable notice. If the customer does not wish to accept a material change affecting a future subscription period, they may cancel before the change takes effect.

38. General

If part of these Terms is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a right immediately does not waive that right. A property manager may not transfer their Snap Rent Appraisal account or contract without our consent, which will not be unreasonably withheld where the relevant agency business is legitimately transferred. We may assign or transfer the Snap Rent Appraisal business and associated contracts as part of a bona fide sale, restructure or corporate transaction, subject to applicable law.
